Terms and Conditions of Part-time Employment for Faculty and Instructors
Each Valencia College part-time faculty member and instructor will be held to the
following employment terms and conditions, per their contract.
These Terms and Conditions of Part-time Employment for Faculty and Instructors (the “Terms”), together with a Faculty Load and Compensation/Electronic Personnel Action Form in effect and the applicable job description, constitute the contract for employment (collectively, the “Agreement”) between the District Board of Trustees of Valencia College, Florida, ( the “College” or “Board”), and the individual indicated in the FLAC/EPAF (“ the “Faculty Member” or “Instructor”). No additional signature shall be required to make these Terms part of the Agreement; an offer from the College and acceptance by the Faculty Member or Instructor of the FLAC /EPAF that incorporates these Terms shall obligate the parties to the provisions below. In consideration of the mutual agreements, terms and conditions contained in the Agreement, the parties agree.

Term/Employment Period |
The Board agrees to employ the Faculty Member or Instructor in the assignment indicated in, and for the compensation specified in, the Faculty Load and Compensation (FLAC) or Electronic Personnel Action Form (EPAF), (collectively, “FLAC/EPAF”) which shall be issued on a semester basis. When an assignment ends by the terms of the FLAC/ EPAF, the Faculty Member or Instructor shall cease to be employed by the College. It is expressly understood and agreed by and between the parties hereto that neither the Faculty Member or Instructor nor the College owes any further contractual obligation to the other after the Agreement end date set forth in the EPAF/ FLAC, except for the Faculty Member or Instructor's obligation to perform uncompleted duties as described below. |
No Expectation Of Future Employment At College |
No legal cause shall be required of the Board in the event that the Faculty Member or Instructor is not re-employed by the Board in the position held by the Faculty Member or Instructor under the terms of this Agreement after the end date that is reflected in the FLAC/EPAF. By acknowledging this Agreement in the FLAC/EPAF, the Faculty Member or Instructor affirms that they are employed in a position that will not lead to an award of a continuing contract (or tenure) and that no legal cause shall be required of the Board in making a decision not to enter into a future contract with the Faculty Member or Instructor for this position or any other position at the College. |
Suspension Or Termination |
The College may suspend the Faculty Member or Instructor or terminate this Agreement for cause pursuant to law and policies and procedures of the College. The College may terminate this Agreement in the event of insufficient legislative funding, necessary reduction in force, elimination of a program(s) or other financial exigencies. If the Faculty Member or Instructor is employed in a grant, in a program funded by a corporate partner, or other special program and, if the grant or program is terminated or the funds available for the grant or program are reduced, this Agreement may be terminated at the sole discretion of the College, and the Faculty Member or Instructor shall not perform, or be entitled to be paid for, services rendered after the termination date. |
Duties |
The Faculty Member or Instructor shall devote their knowledge, skill and working time to the interests of Valencia College and shall execute their duties to the satisfaction of the president or designee. The Faculty Member or Instructor agrees to perform those services required for the aforementioned position at times and locations designated by the president or designee, and not to be absent from duty without authorized leave or release from this Agreement by the College. The Faculty Member or Instructor agrees to be present and to perform those services outlined in the current job description and such other duties as may be assigned; the Faculty Member or Instructor’s job description, as may change from time to time, is incorporated into this Agreement by this reference. Duties prescribed in the Agreement include, but are not limited to, the functions outlined in the related job description and attendance at mandatory college/department/division/discipline meetings, completing all required college and departmental training, participation in onboarding activities, providing a current syllabus to the division, maintaining accurate course and grade records, providing timely feedback to students, accurately reporting student attendance within the prescribed timeframe and submitting final course grades by the stated deadline. |
Conclusion Of Duties |
In the event prescribed services have not been completed and final grades have not been submitted on the last day of the Agreement’s term, the College may withhold the final installment of the contracted pay until duties have been performed. |
Benefits |
The Faculty Member or Instructor will be enrolled by the College in the Alternative Plan to Social Security in lieu of participating in and contributing to Social Security. The Faculty Member will contribute 7.5% of base salary, as paid in each bi-weekly installment, to the Alternative Plan to Social Security, such contribution to be deducted from each bi-weekly installment. Benefits may be provided to part-time faculty and part-time instructors as determined by the College. |
Course Cancellation |
The Faculty Member or Instructor agrees that if an authorized College representative determines that the enrollment is insufficient to justify offering a course and the course is cancelled before the first day of class, that the Faculty Member or Instructor shall not be compensated for the cancelled course(s). |
Applicable Law |
This Agreement shall be governed by the laws of the State of Florida and exclusive venue with respect to any litigation shall be in courts of competent jurisdiction located in Orange County, Florida. This Agreement shall also be performed subject to all applicable federal laws and all applicable administrative rules adopted or promulgated by the Florida State Board of Education, and each other state or local governmental agency having jurisdiction to take action affecting the operations of the College. This Agreement shall be subject to acceptance or rejection for cause by the District Board of Trustees. Furthermore, this Agreement shall include and be subject to the right of state and federal governmental bodies to lawfully make modifications, additions, and deletions to those laws, rules, regulations, policies and guidelines during the term of this Agreement. |
Policies And Procedures |
The Faculty Member or Instructor is bound by the policies and procedures enacted or authorized by the College and as may be adopted and amended from time to time. By acknowledging the Faculty Load and Compensation (FLAC) or Electronic Personnel Action Form (EPAF) the Faculty Member or Instructor agrees that it is the Faculty Member or Instructor’s obligation to review all policies and procedures which are available on the college’s web site located at https://valenciacollege.edu/about/general-counsel/policy/index.php. |
